U.S. Dept. of Labor's Wage and Hour Division Releases Additional Guidance as Workplaces Reopen

Today, the U.S. Dept. of Labor's Wage and Hour Division (WHD) released additional guidance to assist workers and employers with how the requirements and protections provided by the Fair Labor Standards Act (FLSA), the Family and Medical Leave Act (FMLA), and the Families First Coronavirus Response Act (FFCRA) impact the workplace as workplaces continue to reopen across America. The new guidance provides simple and direct questions and answers addressing issues under all three laws.

Today's guidance adds to a growing list of compliance assistance materials published by the WHD, including a Fact Sheet for Employees, a Fact Sheet for Employers, and Questions and Answers about paid sick and expanded family and medical leave under the FFCRA. The WHD's guidance also includes two posters, one for federal employees and one for all other employeesThese posters fulfill notice requirements for employers obligated to inform employees about their rights under the FFCRA. The WHD's guidance also includes Questions and Answers about these posting requirements and a Quick Benefits Tips sheet to assist employers and employees in determining how much paid leave workers may take under the FFCRA.
